Terms of Use
Last updated: 27 October 2026
These terms are an agreement between you and HESTERVALE LLC (“we”, “us”) for the use of the Halcyo app. By downloading or using the app, you agree to them. If you don’t agree, please don’t use the app.
1. What Halcyo is, and what it isn’t
Halcyo is a relaxation and self-help app for people living with tinnitus. It offers sound, a self-guided program and check-ins.
Halcyo is not a medical device. It does not diagnose, treat, cure or prevent tinnitus or any other condition, and it does not replace advice from a doctor, audiologist or therapist. If your hearing changes suddenly, if your tinnitus is new, one-sided or pulses with your heartbeat, or if it comes with dizziness, pain or other new symptoms, see a doctor. In an emergency, call your local emergency number.
2. The AI coach
The AI coach is not available yet. This section applies once it is offered in the app.
The coach writes replies with an AI model. Replies can be wrong or incomplete and are not professional advice. Don’t rely on them for decisions about your health, and use your own judgement. You agree not to use the coach for anything unlawful or abusive, not to try to make it ignore its instructions, and not to access it with automated tools. We may limit the number of messages per day.
3. Hearing safety
Keep the volume low and comfortable. The app limits output levels, but your device and headphones also affect loudness. Stop and lower the volume if you feel discomfort, pain or fullness in your ears.
4. Subscriptions and free trial
- Halcyo’s features require a subscription, offered monthly or yearly. Prices are shown in the app before you buy and may vary by country.
- If you start a free trial, you will be charged when it ends unless you cancel at least 24 hours before the end of the trial.
- Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the period ends. Your App Store or Google Play account is charged for renewal within 24 hours before the end of the current period.
- You can manage and cancel your subscription in your App Store or Google Play account settings. Deleting the app does not cancel it.
- Payments and refunds are handled by Apple or Google under their terms. If we change prices, you will be told in advance and can cancel before the new price applies.
5. Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial use, in line with these terms and the rules of the store you downloaded it from. You may not copy, modify, resell or reverse engineer the app except where the law allows it.
6. Our content
The app, its sounds, lessons, design and the Halcyo name belong to us or our licensors and are protected by law.
7. Disclaimer
We work hard to keep Halcyo useful and available, but the app is provided “as is” and “as available”. To the extent the law allows, we don’t guarantee that it will be uninterrupted, error-free or produce any particular result.
8. Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability to you is limited to the amount you paid for the app in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence, or your statutory rights as a consumer.
9. Apple App Store terms
If you downloaded Halcyo from the Apple App Store, you and we acknowledge that:
- These terms are between you and us only, not Apple. We, not Apple, are solely responsible for the app and its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the app.
- We, not Apple, are responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection claims.
- If a third party claims that the app infringes its intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
10. Changes and termination
We may update these terms. We will post changes here and, if they are significant, tell you in the app. You can stop using the app at any time. We may suspend access if you seriously break these terms.
11. Governing law
These terms are governed by the laws of the State of Wyoming, United States. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in your local courts.
